In its Consumer Agenda 2030, the European Commission announced a Digital Fairness Act proposal for Q4 2026. According to reports from Brussels, it is expected in November 2026; at the time of writing it had not yet been published.
Expected topics: dark patterns beyond the current UCPD and Art. 25 DSA rules; addictive design such as infinite scroll and reward mechanisms; influencer marketing; unfair personalisation of advertising and prices; subscriptions (easier cancellation, renewal reminders, free trials); simplification of information duties.
Entry into force will likely take several years, but many targeted practices are already unlawful under the UWG and the DSA. We will update this post once the proposal is published.
