On 27 March 2025, the BGH confirmed that data protection breaches can be pursued under the UWG – by consumer associations (I ZR 186/17, “App-Zentrum”) and by competitors (I ZR 222/19, I ZR 223/19, “Lindenapotheke”), following the CJEU (C-319/20; C-21/23).
